These Terms and Conditions govern the use of the Harmonydrop platform. By using the Platform, you agree to be bound by these terms. If you do not agree with any part of these terms, please refrain from using the Platform.

1. Acceptance of Terms

By using or accessing the Platform, you confirm that you have read, understood, and agree to comply with these Terms and Conditions. These Terms may be updated periodically; we encourage you to review them frequently.

2. Services Offered

Harmonydrop is a platform that allows users, particularly DJs and music creators, to upload, share, and distribute remixes, mashups, and other musical content ("Content"). We provide tools for creation and promotion.

3. Registration and Account

To access certain services offered by the Platform, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You declare that all information provided during registration is accurate and up-to-date.

You must be at least 18 years old to use this site. You are responsible for any activity that occurs under your username. You must not abuse, harass, threaten, or intimidate other users of Harmonydrop. You must not create or send unsolicited emails to any member of Harmonydrop ("Spam").

4. User Content

Users can upload musical content in the form of mashups, remixes, and other creative materials. By uploading content to the Platform, you represent and warrant that you own all necessary rights to distribute such content. It is prohibited to upload content that infringes the intellectual property rights of third parties.

4.1. Copyright

By uploading content to the Platform, you confirm that you own or have obtained all necessary rights, licenses, consents, and permissions for the use, distribution, and publication of such content. This includes but is not limited to samples, remixes, derivative works, and any other content that uses copyrighted material from third parties.

If your content includes works from third parties, such as samples or musical elements protected by copyright, it is your responsibility to ensure that you have obtained the necessary licenses and permissions for their use. If you upload content without proper authorization, you may be subject to legal penalties, and Harmonydrop reserves the right to remove such content without notice.

Content Removal: You may revoke this license by removing your content from the Platform; however, you agree that such revocation will not affect any previous uses of the content (e.g., ongoing promotions or content shared by other users through sharing tools). We reserve the right to remove or disable access to any content at our discretion if we believe it violates third-party rights or contravenes these Terms and Conditions.

Liability for Violations: If you post content that infringes the intellectual property rights of third parties, you agree to indemnify and hold Harmonydrop harmless from any claims, legal actions, damages, or costs arising from such infringement.

4.2. User Responsibility

If you upload content that contains samples or remixes of other musical works, you are responsible for ensuring that you have the legal right to use such materials. We reserve the right to remove content that violates copyright laws or other applicable regulations.

5. Payments and Subscriptions

Harmonydrop may offer both free and paid services. Should subscription options be offered, details regarding costs, duration, and payment conditions will be clearly indicated on the dedicated page.

5.1. Refunds

Payments made for services, subscriptions, or content purchases on the Platform are generally non-refundable unless otherwise explicitly stated or required by law.

However, we reserve the right to evaluate refund requests on a case-by-case basis, taking into account the following conditions:

Refund Requests for Subscriptions:

• Free Trial: Users have access to a free trial that allows them to upload up to 10 tracks on the Platform. Once this limit is reached, the upload functionality will be disabled, and the user can choose whether to subscribe to continue uploading additional tracks.
• No Automatic Renewals: Harmonydrop does not offer automatic renewals for subscriptions. Upon expiration of the subscription, users will be notified and can freely decide when and if to resubscribe. The upload functionality will simply be disabled upon expiration, and a notification will be sent to the user.
• Exceptions: In exceptional circumstances, such as prolonged technical issues that prevent access to the service or erroneous charges, you may be eligible for a partial or full refund.

Refund Request Process: Refund requests must be submitted within 14 days from the date of purchase or charge, providing a detailed description of the issue. You can contact our support team at: rimborso@harmonydrop.com. Our team will review your request and notify you of the outcome within 7 business days. If approved, the refund will be issued using the same payment method used for the purchase.

7. Limitation of Liability

We do not guarantee that the Platform is error-free or continuously available. To the fullest extent permitted by law, we disclaim any liability for indirect, incidental, or consequential damages arising from the use of the Platform.

8. Changes to Terms

We reserve the right to modify these Terms at any time. In such cases, we will post the changes on the Platform and, if necessary, notify you via email.
